TIWAY CHAIR AND FURNITURE SALES TERMS AND CONDITIONS

Custom orders, wood finishes, and upholstery

§ 1. Custom orders

1. TIWAY fulfills orders for chairs and furniture in accordance with the specifications agreed upon with the Customer, including in particular the selected model, type and color of upholstery, wood finish, and other available finishing options.

2. In the case of non-prefabricated goods, manufactured according to the Customer's specifications or intended to meet their individualized needs, the right to withdraw from a contract concluded at a distance or off-premises may be excluded under the terms set out in Article 38(1)(3) of the Consumer Rights Act.

3. Before placing an order, the Customer is informed about its specifications, selected materials, colors, and the terms of order fulfillment.

4. The exclusion of the right to withdraw from the contract does not limit the Customer's rights resulting from mandatory legal provisions, in particular those concerning the non-conformity of goods with the contract.

§ 2. Wood staining and natural structure

1. Wood is a material with an individual structure and color variation. Consequently, individual wooden elements may differ in grain, shade, the distribution of small spots, discolorations, and other characteristics typical of the material and the finish applied.

2. Wood staining defines the expected shade of the finish, but does not guarantee a perfectly uniform surface free from any variations in structure or color.

3. Color samples, swatches, and product photos are for illustrative purposes only. The actual appearance of the wood may differ slightly from that shown in the photos due to the natural properties of the material, lighting, screen settings, and photography conditions.

4. Variations resulting from the natural structure of the wood, which fall within the agreed product specifications and the properties of the material used, do not in themselves constitute grounds for considering the product non-compliant with the contract.

5. The provisions of this paragraph do not exclude the Seller's liability for defects or for the non-conformity of the goods with the contract.

§ 3. Orders placed without a showroom visit

1. The Customer may place an order without visiting the showroom in person, based on photos, presentation materials, samples, or information provided by the Seller.

2. The Customer acknowledges that photographs may not always perfectly capture all characteristics of a material, particularly wood structure, small markings, grain patterns, subtle shade variations, and upholstery texture.

3. If there are any doubts regarding the appearance of a material, the Customer may request additional photos, a video recording, or information about the chosen finish before placing an order, provided such materials are available.

4. Placing an order without viewing the product in person means that the Customer did not have the opportunity to inspect the specific item before purchase. This does not, however, waive any rights the Customer is entitled to under applicable law.

5. The Seller makes every effort to ensure that presentation materials accurately represent the products offered and their finishes.

§ 4. Order confirmation

1. Before the order is processed, the Customer should verify the agreed-upon specifications, in particular the chair model, the color and type of upholstery, and the finish of the wooden elements.

2. The order confirmation serves as the basis for manufacturing the product in accordance with the agreed-upon specifications.

3. Any changes to the order after production has begun require agreement with the Seller. The possibility of implementing them depends on the stage of completion and technical production capabilities.

§ 5. Final provisions

1. These Terms and Conditions shall be interpreted in accordance with the applicable provisions of Polish law.

2. No provision of these Terms and Conditions limits the statutory rights of the consumer or excludes the Seller's liability in cases where such exclusion is prohibited by law.

3. The Terms and Conditions must be made available to the Customer before the conclusion of the contract in a manner that allows them to review their content.
